Liability Insurance - Texas AG Opinion Request PDF Print E-mail

The Texas Attorney General received a request for an opinion from the Texas Higher Education Coordinating Board on-behalf of San Jacinto College.  The request asks whether the purchase of liability insurance to cover claims for the operation of a day care center on the premises of a community college violates the Texas Constitution.   The request contains an overview of various legal references, including: (A.)  Community  colleges' and school districts' substantial immunity from tort claims; (B.)  Limits for damages against a local government under the Texas Tort Claims Act; and (C.) Restrictions on expenditures of public funds under Article III, Section 52(a), Texas Constitution.
