TEA Releases Annual Update on Legal Interpretations on Student Attendance, Admission and Enrollment PDF Print E-mail

On August 17, 2010, Mr. David Anderson, General Counsel, Texas Education Agency, released letters on various student attendance, admission, and enrollment related-issues.  These letters are released annually to update all public school stakeholders.  Mr. Anderson released one letter addressing various statutory provisions applicable to both school districts and charter schools and another letter specific to charter schools (accordingly, charter school administrators and other charter school stakeholders should read both letters). 

The letters must be reviewed carefully to ensure eligibility for special program and Foundation School Program state aid funding, and to understand interpretations (as of the date of the letters) for various compliance-related matters.  Local systems for tracking data related to eligible attendance and special program participation, in addition to administrative procedure manuals, need to be carefully reviewed for required adjustments to ensure accurate and complete reporting of data in PEIMS reports to the Texas Education Agency.  Please note the statement at the end of each letter that Mr. Anderson only provided summary information in the letters and the information will need to be cross-referenced, as necessary, to law, rules, regulations, Student Attendance Accounting Handbook and other references.
