This week, the State Board of Education agenda includes for second reading and final adoption a proposed amendment to indirect cost rates for Foundation School Program (FSP) Special Programs. The proposed amendment is to Title 19, Texas Administrative Code Chapter 105, Foundation School Program, Subchapter B, Use of State Funds, Section 105.11, Maximum Allowable Indirect Cost. The proposed amendment is to increase FSP indirect cost rates relative to the rates that applied in school year 2010-11, as shown in the table below.

Beginning with school year 2012-13 under the proposed amendment, a school district will be allowed to choose the higher of the school year 2011-12 rates shown above or rates calculated by the Commissioner of Education proportionate to the extent a district receives less funding per weighted student in state and local maintenance and operations revenue than in school year 2011-12.
